This year seems to be getting worse for Apple as each day is passing by. Following a lawsuit filed by Nokia regarding patent infringements, the tech giant's "Apple FaceTime" has now been sued for a terrible car crash that took the life of a 5-year old girl in Texas. The parents of the girl blame Apple as the driver of the other car was using their tech when the accident happened.

The mishap took place on December 24, 2014, in Texas, when a 22-year-old Garrett Wilhelm failed to stop his car in time. According to the Apple lawsuit, Wilhelm was using "Apple FaceTime" while driving 65mph on Interstate I-35 near Dallas and slammed into the back of a Toyota Camry. Both the parents, James and Bethany Modisette, were sitting on the front seat of the vehicle and their 5-year old daughter Moriah Modisette was in the back seat at the time of the accident. While the car hit injured the parents, doctors couldn't save Moriah from the untimely death.

According to Courthouse News, the Apple lawsuit states the tech giant was granted an "Apple FaceTime" design patent back in 2014, which would've used GPS tracking to prevent people from using the app while driving at fast speeds. However, Apple did not implement the design and neither did it install a feature to warn the drivers against using the app.

Had the feature been launched earlier at the time the patent was approved, Wilhelm would've been able to stop his car and prevent the accident from happening. The Apple FaceTime lawsuit states that Modisette' vehicle was going at a slow pace along with other vehicles because of a traffic accident when Wilhelm's vehicle rolled "up and over the driver's side of the Modisette car."

According to Denton Record-Chronicle, James, Bethany, and Wilhelm were taken to Denton Regional Medical Center by ambulance, whereas Moriah was airlifted to the Cook Children's Medical Center in Fort Worth, where the doctors declared her dead. The "Apple FaceTime" app on Wilhelm's vehicle was still active when Police arrived at the scene.

A manslaughter charge has now been filed against Wilhelm, however, it cannot be ignored that Apple was partially responsible for the 5-year old girl's death.
